Terms & Conditions

Please read these Terms and Conditions carefully before scheduling service, signing any service agreement, or purchasing any products or maintenance plans from Evergreen Douglas Solutions.

By engaging our services, you agree to be bound by the following terms.

Section 01

About Evergreen Douglas Solutions

Evergreen Douglas Solutions is a licensed HVAC (Heating, Ventilation, and Air Conditioning) company providing residential and commercial installation, repair, maintenance, and replacement services. We operate in accordance with all applicable state and local licensing requirements and safety codes.

References to "we," "us," "our," or "the Company" in these Terms refer to Evergreen Douglas Solutions and its employees, contractors, and representatives.

Section 02

Service Agreements & Estimates

All estimates provided by Evergreen Douglas Solutions are based on an initial assessment and are subject to change once work has commenced if unforeseen conditions are discovered. We will notify you of any significant cost changes before proceeding with additional work.

Written estimates are valid for 30 days from the date of issuance unless otherwise stated.

Estimates do not constitute a binding contract until a signed service agreement or work order is executed.

Emergency service calls may be subject to additional fees, which will be disclosed prior to service.

Diagnostic fees may apply and will be communicated upfront.

Section 03

Payment Terms

Payment is due upon completion of service unless other arrangements have been made in writing. For larger installations or commercial projects, we may require a deposit prior to scheduling work.

Accepted Payment Methods: Cash, check, major credit/debit cards, and approved financing options. Checks should be made payable to Evergreen Douglas Solutions.

Invoices not paid within 30 days of the due date are subject to a late fee of 1.5% per month on the outstanding balance.

Returned checks are subject to a $35 returned check fee.

Accounts referred to collections are responsible for all associated collection costs and reasonable attorney's fees.

Section 04

Scheduling & Cancellations

We will make every effort to arrive within the scheduled service window. However, scheduling is subject to availability and unforeseen circumstances such as prior job delays or weather conditions.

We ask for at least 24 hours' notice for cancellations or rescheduling of non-emergency appointments.

Cancellations with less than 24 hours' notice may be subject to a cancellation fee.

No-shows or same-day cancellations after dispatch may be charged a trip fee.

Emergency service is dispatched as quickly as possible and is not subject to guaranteed arrival times.

Section 05

Labor & Parts Warranty

Evergreen Douglas Solutions stands behind the quality of our work. We offer the following warranty protections on completed services:

Labor Warranty: We warranty all labor performed by our technicians for a period of 90 days from the date of service completion, unless otherwise specified in writing.

Parts & Equipment: Manufacturer warranties apply to all installed parts and equipment. We will assist in facilitating warranty claims with manufacturers on your behalf.

Warranties are voided if the equipment is tampered with, modified, or serviced by an unlicensed third party after our work is completed. Warranty coverage does not apply to normal wear and tear, misuse, neglect, or damage caused by external factors such as floods, power surges, or acts of nature.

Section 06

Customer Responsibilities

To ensure safe and effective service, the customer agrees to:

Provide safe and reasonable access to the work area, including attics, crawl spaces, mechanical rooms, and rooftop units.

Disclose known hazards such as asbestos, mold, or structural issues prior to service.

Ensure pets are secured and children are kept away from active work areas.

Ensure that a responsible adult (18+) is present on-site during all scheduled service appointments.

Inform us of any HOA requirements or building permit obligations that may affect the work.

Section 07

Limitation of Liability

Evergreen Douglas Solutions shall not be liable for any indirect, incidental, consequential, or punitive damages arising from our services, including but not limited to loss of use, lost revenue, property damage unrelated to our work, or equipment failure due to pre-existing conditions.

Our total liability for any claim arising from services rendered shall not exceed the total amount paid by the customer for the specific service in question.

We are not responsible for damage caused by conditions that were pre-existing and not disclosed at the time of service, or for issues arising from equipment that was outside the scope of the agreed-upon work.

Section 08

Maintenance Plans

Customers who enroll in a recurring maintenance plan agree to the following additional terms:

Maintenance plans are billed on a monthly or annual basis as selected at enrollment.

Plans may be cancelled with 30 days' written notice; no partial refunds will be issued for unused months within a paid period.

Maintenance visits must be scheduled during regular business hours unless an upgraded plan is in effect.

Evergreen Douglas Solutions reserves the right to adjust plan pricing with 60 days' written notice to existing customers.

Section 09

Privacy & Data Use

We collect customer information (name, address, contact details, service history) solely for the purpose of providing our services, communicating with you, and improving our offerings. We do not sell or share your personal information with third parties for marketing purposes.

By providing your contact information, you consent to receive service reminders, appointment confirmations, and follow-up communications via phone, email, or text. You may opt out of non-essential communications at any time by contacting our office.

Section 10

Dispute Resolution

In the event of a dispute arising from our services, we encourage customers to first contact us directly so we can work toward a resolution. We are committed to customer satisfaction and will make a good-faith effort to address concerns promptly.

If a dispute cannot be resolved informally, both parties agree to pursue resolution through binding arbitration in accordance with applicable state laws, rather than through litigation, except in cases involving small claims court matters.

These Terms and Conditions shall be governed by the laws of the state in which services are rendered.

Section 11

Changes to These Terms

Evergreen Douglas Solutions reserves the right to update or modify these Terms and Conditions at any time. Updated terms will be posted on our website and/or provided to customers upon request. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
